The FCC's job is not to put a finger in the wind and decide which way the winds are blowing; it's to look at the facts and make a sober judgment based on what the law is.
My approach to deciding cases is I look at the law, I look at the facts, and I do my best to apply the law to the facts and make a decision based on the law and the facts.
I have had to make a decision I may not agree with, but I am required to follow the letter of the law. It is not my job to think what is best... My responsibility is to decide what the law says and to decide to the law.
The same wind blows on us all; the winds of disaster, opportunity and change. Therefore, it is not the blowing of the wind, but the setting of the sails that will determine our direction in life.
For the law, the clarity of language and the finality of judgment is crucial, because you have to decide a case one way or another - whether it is criminal or civil or whatever. In ordinary life, you do not have to decide things with absolute finality. You do not have to decide on a theory in order to behave in a certain way towards other people.
The wind is blowing; those vessels whose sails are unfurled catch it, and go forward on their way, but those which have their sails furled do not catch the wind. Is that the fault of the wind? Is it the fault of the merciful Father, whose wind of mercy is blowing without ceasing, day and night, whose mercy knows no decay, is it His fault that some of us are happy and some unhappy? We make our own destiny. His sun shines for the weak as well as for the strong. His wind blows for saint and sinner alike. He is the Lord of all, the Father of all, merciful, and impartial.
I'd buy myself a cabin on the beach, I'd put some glue in my navel, and I'd stick a flag in there. Then I'd wait to see which way the wind was blowing.
We reap what we sow. We are the makers of our own fate. The wind is blowing; those vessels whose sails are unfurled catch it, and go forward on their way, but those which have their sails furled do not catch the wind. Is that the fault of the wind?....... We make our own destiny.
The bedrock of our democracy is the rule of law and that means we have to have an independent judiciary, judges who can make decisions independent of the political winds that are blowing.
I think it's dangerous to make a decision based on where one thinks the public may or may not be. Aside from the fact that that's not what the law prescribes, it's also, I think, not what reasoned decision-making is all about... You always try to look at the facts and apply the law faithfully.
Straw shows which way the wind is blowing.
Under the law, the FCC does not have the authority to revoke a license of a broadcast station based on the content of a particular newscast.
Look at your hand. Its structure does not match the structure of assertions, the structure of facts. Your hand is continuous. Assertions and facts are discontinuous.... You lift your index finger half an inch; it passes through a million facts. Look at the way your hand goes on and on, while the clock ticks, and the sun moves a little further across the sky.
You come to me and it's my job to make you look the best you can look. From an image point of view, would I prefer to dress Jude Law instead of Rolf Harris? Of course. But it's my job to make them both look great.
A law of nature is not a formula drawn up by a legislator, but a mere summary of the observed facts - a "bundle of facts." Things do not act in a particular way because there is a law, but we state the "law" because they act in that way.
People who make documentaries have to be faithful to the facts. But when you are making a drama, a fiction based on the life, all you have to be faithful to is the spirit of the facts, which I think I was in every case. As long as you don't violate their spirit, you can play with the facts.
We decide based on how people look; we decide based on how people sound; we decide based on how people are dressed. We decide based on their passion.
