Let's get this straight now: a Senate impeachment trial is not a court of law. It's a court of politics.
If the Senate impeachment trial were a real court, all 100 senators would be removed as jurors for bias for or against the president.
What often happens in a court of law is that, if victims do get their day in court, they are on trial as much as the perpetrators.
Most lawyers aren't trial lawyers. Most lawyers, even trial lawyers, don't get their problems solved in a courtroom. We like to go to court. It seems heroic to go to court. We think we're the new, great advocates, better than anything we've seen on TV, and we come home exhilarated by having gone to court.
CBS exhausted the Texas courts. They went from the trial court to the intermediate court to the highest court.
A Court of equity can mould interests differently from a Court of law; and can give relief in cases where a Court of law cannot.
It is not the practice, now will I allow subversives to get away by insisting that I’ve got to prove everything against them in a court of law or [produce] evidence that will stand up to the strict rules of evidence of a court of law.
Uganda's Constitutional Court will decide whether the military court can proceed with this trial. A nation cannot claim to be operating under the rule of law if its military tribunals ignore the orders of civilian courts.
Now I am practicing as well as a criminal defense lawyer in handling appeals. The court of appeals appointed me to handle cases and although that's not trial work and I don't have to go to court, it kind of satisfies the need I have to practice still and I have transitioned into readiness not to be in trial anymore. It took a little while for me to get used to not doing it and I did miss it for a few years, but eventually I transferred into another life.
At issue here is a basic law which enables the Supreme Court to quash laws in extreme cases. Up until now, this right of the Supreme Court was not mentioned anywhere, but was just taken. At the same time, we want to enable the Knesset to overrule decisions of the Supreme Court.
But the Supreme Court does not make sweeping changes in constitutional law by accident, or by its own design. Rather, the Court is limited to deciding the cases that the parties ask the Court to decide.
Life has changed both on and off the court after the Rio Olympics medal. I have a lot of confidence on the court now and feel anything is possible. I also feel that I have improved my game. Off the court, I do get recognised more now.
The President wants me to argue that he is as powerful a monarch as Louis XIV, only four years at a time, and is not subject to the processes of any court in the land except the court of impeachment.
Where trial-court and appeals-court nominees were once routinely confirmed on voice vote, they are now routinely subjected to ideological litmus tests, filibusters, and vicious interest-group attacks.
Though this motion for a new trial is an application to the discretion of the Court, it must be remembered that the discretion to be exercised on such an occasion is not a wild but a sound discretion, and to be confined within those limits within which an honest man, competent to discharge the duties of his office, ought to confine himself. And that discretion will be best exercised by not deviating from the rules laid down by our predecessors; for the practice of the Court forms the law of the Court.
The Supreme Court is about the Constitution. It is about constitutionality. It is about the law. At its bear simplest, it's about the law. It is not about the Democrat Party agenda. Because that's what it's become. The whole judiciary has become that because that's the kind of people they have put on various courts as judges, and every liberal justice on the Supreme Court is a social justice warrior first and a judge of the law second. And if they get one more, then they will have effectively corrupted the Supreme Court.
Class warfare always sounds good. Taking action against the rich and the powerful and making 'em pay for what they do, it always sounds good. But that's not the job of the Supreme Court. The Supreme Court standing on the side of the American people? The Supreme Court adjudicates the law. The Supreme Court determines the constitutionality of things and other things. The Supreme Court's gotten way out of focus, in my opinion.
