Many of the ugly pages of American history have been obscured and forgotten. A society is always eager to cover misdeeds with a cloak of forgetfulness, but no society can fully repress an ugly past when the ravages persist into the present. If an agency is the ultimate judge in every case of conflict, then it is also judge in all conflicts involving itself. Consequently, instead of merely preventing and resolving conflict, a monopolist of ultimate decision making will also cause and provoke conflict in order to settle it to his own advantage. That is, if one can only appeal to the state for justice, justice will be perverted in the favor of the state, constitutions and supreme courts notwithstanding.

The court thinks he is trying to be gracious, sharing his attention. Only I see that he moves always to the empty spot and the court always moves after him. I was amused by the analogy that Justice Scalia made in a case about a GPS tracker so you don't know that's being done to your car, is that a violation of your right to protection against unreasonable searches and seizures. So Justice Scalia imagines a constable clinging to the bottom of a carriage as it went on its way, so there was some notion that this similar: there is an official eye that's on you, but you don't know about it. Yes, there are all kinds of challenges.
He was a worshiper of liberty, a friend of the oppressed. A thousand times I have heard him quote these words: 'For Justice all place a temple, and all season, summer.' He believed that happiness is the only good, reason the only torch, justice the only worship, humanity the only religion, and love the only priest. He added to the sum of human joy; and were every one to whom he did some loving service to bring a blossom to his grave, he would sleep tonight beneath a wilderness of flowers. . . .
I don't think you ever want to be too settled, because once you become settled, you lose a lot of your drive. I mean, I am settled off the court; the business side of things, the papers, contracts and all of that, but there are a lot things that I need to work on, on the court, like my free-throw shooting, which has been terrible. Yet injustice among men is ever on the increase; the outrages committed against the masses in this country alone would seem enough to overflow the very heavens. But where are the gods to make an end to all these horrors, these wrongs, this inhumanity to man? No, not the gods, but MAN must rise in his mighty wrath. He, deceived by all the deities, betrayed by their emissaries, he, himself, must undertake to usher in justice upon the earth.

There's no fundamental platform being brought by activists in Oakland, Baltimore, or New Jersey. The main issues that you see, the commonality between activists all around the country, are trying to deal with the challenges in the criminal justice system, something that is very much central to my work. So my hope is that people stay focused on the urgency to create justice here at home.

The great biblical tradition says that loving God and loving one's neighbor are not two separate actions but two sides of the same action. In our country, [habeas corpus ] means that if you've been sentenced and convicted in a state court, either to death or to some other kind of sentence, you have the right to petition a federal court to review what happened to you. And until [Bill] Clinton, you had three, four, five, even more years I collect records of people who have been on death row for eight, 10, 12, 14 years - this is before Clinton - who finally got a decent lawyer, usually a pro bono lawyer, and an investigator, and were able to find out - they - they're but approved that they're - that they were innocent.

How far does one combine resistance to over-control with social justice, i.e. tolerable living for people in general? We are too selfish to be trusted, if left free, to give away enough to make people comfortable enough to give them a chance. Yet if all this is ordered for us, as to some extent it has to be, it so soon leads to tyranny. It is a very difficult problem. If only human beings had more pity, unselfishness, and justice and didn't need coercion to treat each other decently.
